This paper explores the use of an ethics framework based on the Public Health Code of Ethics to guide rationing decisions during a pandemic flu crisis involving a shortage of ventilators. While the law provides public health officials with authority to act, public health officials, as community leaders and health department managers, must address complex questions about how they should use their legal authority, how they can ethically justify a particular action, how they should engage community stakeholders in decision making, (...) and how the process of public justification should take place. Recognising the need for a tool that could help public health officials manage ethical tensions in practice, such as allocation of scarce resources, the Public Health Leadership Society led efforts to develop a Public Health Code of Ethics. The 12 Principles in the Code were written to express the general norms implicit in the practice of public health professionals. The Code offers no hierarchical weighting of the different principles and anticipates that weights and specification of the principles would take place in the context of each community through a process of engagement between public health officials and community stakeholders about specific cases. We describe how public health officials can use the Code to guide deliberation in helping communities prepare to address the tragic choices when allocating scarce ventilators in an influenza pandemic. As Dobzhansky wrote, nothing in biology makes sense outside the context of the evolutionary theory, and this truth has not been sufficiently explored yet by medicine. We comment on Shanks and Pyles' recently published paper, Evolution and medicine: the long reach of "Dr. Darwin", and discuss some recent advancements in the application of evolutionary theory to carcinogenesis. However, we disagree with Shanks and Pyles about the usefulness of animal experiments in predicting human hazards. Based on the darwinian observation of inter-species (...) and inter-individual variation in all biological functions, Shanks and Pyles suggest that animal experiments cannot be used to identify hazards to human health. We claim that while the activity of enzymes may vary among individuals and among species, this does not indicate that critical events in disease processes occurring after exposure to hazardous agents differ qualitatively between animal models and humans. In addition, the goal is to avoid human disease whenever possible and with the means that are available at a given point in time. Epidemics of cancer could have been prevented if experimental data had been used to reduce human exposures or ban carcinogenic chemicals. We discuss examples. (shrink)

This book offers a critical introduction to the work of American philosopher D. G. Leahy (1937-2014). Leahy's fundamental thinking can be characterized as an absolute creativity in which all creating is 'live' -- a happening occurring now that manifests a supersaturated polyontological actuality that is essentially created by the logic that characterizes it. Leahy leaves behind the categorial presuppositions of modern thought, eclipsing both Cartesian and Hegelian subjectivities and introducing instead an essentially new form of thinking founded in a nondual (...) logic of creation. The contemporary discussion of non-conceptual content inaugurated by Gareth Evans and John McDowell has generated a range of differing views as to Kant's position on the issues raised. I argue that for Kant perception is prior to thought and that it is as being prior that perception connects us to reality in outer intuition. I then argue that for Kant thought relates to perception by being the rule for perceptual procedures. This accounts for thought's extending in scope beyond what we (...) actually perceive to all that is manifest in space and time. As against Merleau-Ponty this Kantian understanding of thought beyond perception does not distort the nature of reality which remains essentially that which can be engaged. (shrink)

A poetic study of a singular form of urban industrial art and its place in American culture. They lie underfoot, embellished and gleaming. They seal off and provide entry to an underground world of conduits, water mains, power lines, and sewers. They appear by the thousands in our cities, but very few people ever look at them or think about them as art. At once completely ordinary and totally unexpected, manhole covers present an infinite variety of design in the commonplace (...) as well as a record of defunct utility companies, forgotten business firms, and obsolete foundries. Manhole Covers documents this singular form of urban industrial art and its place in American culture. Mimi and Robert Melnick first revealed their obsession with street hardware twenty years ago in a remarkable little book called Manhole Covers of Los Angeles. Printed in a small format and a limited edition, it quickly went out of print and is now a scarce collector's item. But that was just an introduction to their larger project, which has come to fruition in this book of 200 photographs and an extended narrative documenting manhole covers throughout the United States and discussing the history of their use, manufacture, and function. A subject that at first seems straightforward and commonplace becomes redolent and poetic in the Melnicks' hands, for their hieroglyphic reading of manhole covers reveals a chapter of urban history that can only be recovered from the logos and markings of these early disks. There are square lids, convex lids, perforated lids. And the older ones wear an astonishingly diverse range of anything-but-blank faces expressed in raised crosses, waffle grids, cut-out diamonds, radial stars, floral patterns, and honeycomb treads. The diversity of design corresponds to an equally diverse typology of form and function, as indicated by their evocative labels: handholes, vents, coalholes, grates, lampholes, storm drains, steam covers, meter lids, traffic buttons. According to Kant's theory of thought or cognition, thoughts are rules for empirical reactions in the compass of spatial and temporal constructions. Theses rules function to represent our situation in relation to all the ways it is proper to interact with reality. After outlining Kant's theory, I present a modified version in which rules are identified with executive mechanisms for behavioural output. Following Kant, I show how such rules can pertain to the past in terms of mechanisms for being beyond (...) or past stages of temporal constructions. This identification of rules with mechanisms allows for a real definition of the truth of thoughts as the active realizability of the mechanisms that thoughts are. I show how this modified version can encompass the full scope of even relativistic spatio-temporal reality, and indicate why this theory deserves consideration as against rival descriptive and causal theories of cognition. Finding that an avian herpesvirus can cause atherosclerosis in chickens prompted studies of human herpesviruses in human atherosclerosis. Antigens and nucleic acid sequences of cytomegalovirus (CMV), a widespread member of the herpesvirus family, were found in arterial lesions in human atherosclerosis, but infectious virus has not been observed. In atherosclerosis patients, high levels of CMV antibodies are present, suggesting the presence of virus that had been activated from a latent state. Atherosclerosis also develops in immunesuppressed heart transplant patients infected with (...) CMV. The properties of CMV are consistent with its involvement at several levels of the atherogenic process. If this concept is correct, immunization with a CMV vaccine should prevent CMV infection and atherosclerosis. (shrink)

IN THE FIRST EDITION TRANSCENDENTAL DEDUCTION of the categories Kant does not mention the logical functions of judgment. In the second edition the Deduction can be said to be dominated by the logical functions of judgment. A transcendental deduction supplies a method for showing that pure concepts can have applicability. My contention is that the two deductions constitute exactly the same method, and so are the exact same deduction. The difference between them, rather, is in the characterization of the pure (...) concepts that the method is supposed to be a method for. The undifferentiated categories of the A edition become the logical functions together with their schemata in the B edition. This does not mean that Kant has split the A edition notion of categories since the A edition categories are equivalent to just the schemata themselves. (shrink)

Even thoughts of past time are such thoughts of positioning by being mechanisms for being beyond stages of temporal constructions. This allows a naturalized realist semantics in which the content of thoughts that are in the head is purported existence anywhere in space and time. It could be argued that some in the military, like certain local officials, are the last holdouts against the reform's ideological “thaw” toward religion, though Kharčev's October–November, 1989, interview inOgonëk makes clear that there are still some higher-level forces in “the apparatus” who remain opposed to some of the changes. It could be that some of the reformers themselves are concerned about the pace of change. Even in their minds the “thaw” undoubtedly has limits. They may view the present controversy (...) over restructuring “scientific atheism” and redefining socialism's attitude toward religion as a necessary and desirable part of the dialectical process. Thus, while encouraging a tactical and more humane detente toward religion, they have not yet moved to eliminate the basis for ideological hostility toward it. They simply want that hostility to be better channeled and controlled, while exploiting the political benefits that their new-found truce with religion offers. Looking at Gorbachevism, Soviet émigré observer Aleksandr Zinov'ev believes that the reform process “in the sphere of internal political activity concerns only separate phenomena ... but by no means the very foundations of the social system, the system of power and ideology.” That system, he believes, is not yet fundamentally changing in those terms. Political liberals ask citizens not to appeal to certain considerations, including religious and philosophical convictions, in political deliberation. We argue that political liberals must include a demanding requirement of intellectual modesty in their ideal of citizenship in order to motivate this deliberative restraint. The requirement calls on each citizen to believe that the best reasoners disagree about the considerations that she is barred from appealing to. Along the way, we clarify how requirements of intellectual modesty relate to moral reasons for (...) deliberative restraint. And we argue against attempts to weaken our requirement of intellectual modesty by emphasizing those moral reasons. (shrink)
